A man experienced a terrible car accident in December of 2010 that left him injured and hospitalized. He was injured and trapped in his car beneath the transport truck trailer that landed on top of his vehicle for 90 minutes. He was a victim, he had done nothing wrong, and the other driver was cited for a driving infraction.
The night of the accident he was sitting at a stoplight when his Silverado was slammed into by a tractor trailer that had become detached from the Express Transport Corp truck that it had been attached to. His vehicle was flattened and he became trapped inside. For 90 minutes he remained trapped inside his vehicle, severely injured, until rescuers could remove the trailer and extract him from the wreckage.
His neck was broken and he had spinal fluid leakage, and other serious injuries. He did not think he would survive. It turned out that the trailer became detached from the truck when the driver made an unsafe turn. The Jackson County Sheriff’s Department cited the driver for making an improper turn. For careless driving and he was fined $795.
Though originally asking for $4 million, the victim was willing to settle for much less, around $1.5 million. In his lawsuit, his attorneys made the claim that the brakes were out of alignment on the rear trailer when the accident happened and that the brake slack adjusters were mis-matched. His attorneys settled the case in mediation for an amount that included $300,000 for medical bills, $700,000 in compensation for loss of quality of life and lost wages, and $400,000 for future medical expenses.
